CLEVELAND HEIGHTS, Ohio – A non-profit advocacy law organization is challenging as 'unconstitutional' an annual fee Cleveland Heights imposes on landords who live outside Cuyahoga County. The non-profit law organization 1851 Center for Constitutional Law, filed suit in federal court Jan. 31 in an attempt to overturn the $100 fee. The suit was filed on behalf of Sole Houses LLC and related parties who own rental properties in Cleveland Heights and have been assessed the fee. Maurice Thompson, executive director of 1851, said the orginization has yet to find another city in the state that imposes this assessment, but expressed fear that this 'penalty' would spread to other jurisdictions.
